Terms of Service

Last updated: April 1, 2026

These Terms of Service ("Terms") govern your access to and use of the Diversion platform and the diversionhq.org website, operated by Diversion Company ("Diversion," "we," or "us"), headquartered at 633 West 5th Street, Suite 2800, Los Angeles, CA 90017.

By accessing the Diversion platform or applying for early access, you agree to these Terms. If you are accepting on behalf of a studio or organization, you represent that you have authority to bind that entity.

The Service

Diversion is a version control platform built for game development teams. It provides repository hosting, binary asset management, branch and merge workflows, and engine integrations for Unreal Engine, Unity, and Godot.

During the early access period, features and pricing are subject to change. We will give you reasonable notice before making changes that materially affect your workflow.

Your Account

You are responsible for keeping your account credentials secure. If you believe your account has been compromised, notify us immediately at [email protected].

You may not share your account with others or use your account to access the service on behalf of another organization without a separate agreement.

Acceptable Use

You agree not to use Diversion to:

  • Store or distribute content that infringes intellectual property rights
  • Transmit malware, ransomware, or other malicious code
  • Attempt to gain unauthorized access to other accounts or systems
  • Conduct denial-of-service attacks or load testing without prior written consent
  • Resell or sublicense access to the platform without a written agreement
  • Reverse engineer any component of the Diversion platform

Violations may result in immediate suspension or termination of your account.

Your Data

You retain ownership of all code, assets, and data you store in Diversion. We do not claim any rights over your content. We access your data only as necessary to provide the service or as required by law.

You can export your complete repository history at any time. We support standard export formats and will not hold your data hostage.

Uptime and Support

We target 99.5% uptime for the Diversion platform. Planned maintenance will be announced at least 24 hours in advance. Unplanned incidents will be communicated as quickly as possible via our status page.

Support is available via email at [email protected]. During early access, response times may vary.

Payment and Billing

Early access is provided at no charge until general availability. Pricing for paid tiers will be published before billing begins. You will receive at least 30 days notice before any charges apply to your account.

All prices are in USD. Invoices are issued monthly for monthly plans and annually for annual plans.

Termination

You may terminate your account at any time by contacting us at [email protected]. We will confirm termination and provide a data export within 7 business days.

We may suspend or terminate your account if you violate these Terms. We will notify you before taking action except where immediate action is required to protect the platform or other users.

Limitation of Liability

To the extent permitted by law, Diversion's total liability to you for any claim arising out of or relating to these Terms or the service is limited to the fees you paid in the 12 months preceding the claim.

Diversion is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.

Disclaimer of Warranties

The Diversion platform is provided "as is." We make no warranty that the service will be uninterrupted, error-free, or meet your specific requirements. We disclaim all implied warranties to the fullest extent permitted by law.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Los Angeles County, California.

Changes to These Terms

We may update these Terms. Material changes will be communicated by email or prominent notice on the platform at least 30 days before taking effect. Continuing to use the service after changes take effect means you accept the revised Terms.
